Application by Dexel Development Ltd., requesting non-substantive amendments to an existing development agreement, specifically changes to the site circulation, changes to the location of required amenity space, and changes to the architectural appearance of a 30-storey mixed-use apartment building at 5970 Spring Garden Road, Halifax.
Proposal
The applicant is requesting non‑substantive amendments to the existing development agreement which permits a mixed‑use development consisting of two 30‑storey towers situated over a shared podium with five levels of underground parking.
The proposed amendment includes changes to the vehicular access to the underground parkade on site. Vehicle access provided on Robie Street is proposed to be removed. A new commercial and residential service entrance on Spring Garden Road is proposed, which will provide access to a new commercial service corridor added at the ground floor at the rear of the building. This corridor will serve as access to back‑of‑house operations for the commercial units along Spring Garden Road and will house mechanical equipment as well as serve as the collection point for commercial and residential waste.
Additional changes to the proposed required amenity space locations include removing the requirement for all required amenity space to be provided exclusively on the 4th floor. This change does not reduce the amount of required amenity space but instead allows the developer to relocate amenity spaces elsewhere within the building where they may better align with interior design or functional considerations.
The major aspects of the proposal are as follows:
- Elimination of the Robie Street vehicle access to the site, along with revisions to on‑site vehicular circulation; and
- Text amendments to the development agreement to allow required amenity space to be located anywhere within the tower building; and
- Addition of a commercial service corridor along the southern side of the podium, providing space for mechanical equipment and for commercial and residential waste collection.
The Applicant Rationale and Development Plans (provided below) outline the proposal in detail, and include information related to the project and site design, rationale and traffic impact.
Process

Status
Currently this application is at the report writing stage of the process. It has gone through a detailed team review and a staff report will soon be drafted and forwarded to the Development Officer for review and a decision.

The applicant has submitted plans and studies required by HRM staff to properly evaluate the application. The documents are also available for review at the Planning Applications office at 5251 Duke Street, Halifax, Suite 300.
