Peggy’s Cove Commission initiated amendments to the Peggy’s Cove Land Use By-law to include an expiry date on Development Permits, to allow  permission for a Development Officer to revoke a permit that was issued in error or based on a false application, to allow for the inclusion of metal shingles to section 8.8.4 (list of permitted roof materials), and for the removal of Section 5.8.1 (b) (ii) which was included in error.

The Peggy’s Cove Commission has initiated four (4) amendments (text) changes to the Peggy’s Cove Land Use By-law. Those proposed amendments include:

  • Adding a clause within the Land Use By-law to include an expiry date on issued Development Permits;
  • Adding a clause within the Land Use By-law that gives a Development Officer authority to revoke a permit that was issued in error or where an application was made falsely or with false information or materials;
  • Including metal shingles to the list of permitted roof materials within Section 8.8.4; and
  • Remove Section 5.8.1(b)(ii) as it is inaccurate and was included in error, as the Land Use By-law provides no authority for a Development Officer to vary lot‑frontage requirements during subdivision.

The Peggy’s Cove Land Use Bylaw applies to those properties located within the Peggy’s Cove Preservation Area (PCPA).

Regulatory Context

Halifax Regional Municipality has entered into a service agreement with the Province of Nova Scotia to administer the land use by-law and to process any requests for rezoning or land use by-law text amendments to the Peggy’s Cove Land Use By-law on behalf of the Peggy’s Cove Commission (PCC). Any property located within the Peggy’s Cove Preservation Area (PCPA) will be reviewed and a decision rendered by the PCC.

Note: as per Section 10.8.1 of the Peggy’s Cove Land Use By-law, a decision of the PCC regarding amendments to the Land Use By-law is not appealable to the Nova Scotia Regulatory and Appeals Board.

Process

The application will be considered under the Peggy’s Cove Commission Land Use By-Law Amendment Process.

As per Section 10.5.1 of the Peggy’s Cove Land Use By-Law, a successful motion by the Commission was passed on January 15, 2026 to initiate the process to consider this amendment.

Status

The engagement period for public feedback concluded on April 13, 2026, thank you to all who participated.

Staff are currently in the process of performing a detailed review of the proposal and will begin drafting the proposed amendment(s) and staff recommendation report. Once completed, these will be presented to the Peggy’s Cove Commission for consideration.

Any documents that will be considered under this application by the Peggy’s Cove Commission to properly evaluate the application will be uploaded to the website when available.
